Conceptos de equidad intergeneracional, conservación del recurso, aprovechamiento sostenible, participación, y control social se utilizan por parte de las organizaciones sociales y de Ong, y de igual manera por los foros empresariales, las instituciones públicas, IFIs, Instituciones Financieras Multilaterales con muy diferente contenido.El tema de los derechos de agua (...) como derechos de los inversionistas, y los derechos de propiedad intelectual aplicados a la materia viva y a los conocimientos ancestrales son ejemplos de un tratamiento insostenible de los recursos naturales, pues privilegian el sentido comercial sobre el ambiental. La filosofía analítica de la historia de Danto intenta resolver el problema del límite lógico de la historia a partir de la elaboración de la frase narrativa. Dicha solución implica el rechazo de cualquier tipo de filosofía substantiva de la historia a causa de su compromiso teórico con el realismo narrativo y la transgresión de los límites del lenguaje histórico. The paper explores Alonso de la Veracruz's theses on civil power, which sought to integrate the native inhabitants of the New World into the Spanish political community. These theses, which have usually been associated with F. de Vitoria and Spanish Thomism, have recently come to be considered part of a Novohispanic republicanism developed in the American periphery. The article seeks to show that the purpose of such theses was to apply a theory of natural rights that did not entail the political participation of the indigenous population, as well as to analyze Veracruz's position regarding cultural diversity and the war against the indigenous peoples. El presente artículo surge como una reflexión iusfilosófica sobre la democracia, la justicia constitucional como un elemento esencial en la consolidación del Estado social de derecho colombiano, cuyo paradigma es el sociocrítico, el método es el constructivismo y la técnica concreta de la investigación es la revisión documental, toda vez que permite la interpretación de textos y contextos, en dicho trabajo se muestran los elementos del poder constituyente, poder constituido y nuevo constitucionalismo latinoamericano. La problemática que da lugar al presente (...) ejercicio de investigación es la tensión existente entre la democracia y el constitucionalismo. En esta propuesta se pone de presente que la democracia es otra forma del poder que en el contexto de la presente disertación se exterioriza como un poder absoluto, toda vez que, es un poder sin límites, mientras que el constitucionalismo se presenta como un límite al poder, sin embargo, dichos términos no son del todo antagónicos pues la apuesta a manera de hipótesis es una democracia constitucional, es decir que se pretende un poder democrático limitado por unas normas y principios constitucionales. En este texto se desarrollará una temática problemática y dilemática en tanto que se hará una reflexión sobre los efectos de la pandemia para las personas. Se afirmará que esta pandemia ha dejado enfermedades por tratar y curar; estas enfermedades no son solo del cuerpo; nos ha dejado entender la necesidad de cuidado de sí como un cuidado también del otro. Por esto, planear y proponer algunas virtudes que orienten dicha búsqueda de sabiduría. El texto consta de seis partes donde (...) se enmarcará la pandemia como el problema a abordar, luego se tratará el asunto de la acción humana y sus implicaciones para sí mismo y para el otro; estas acciones provienen de la autonomía y del cuidado de sí que requiere unas virtudes con las cuales se transforma a la persona y a la comunidad. Shared agency is of central importance in our lives in many ways. We enjoy engaging in certain joint activities with others. We also engage in joint activities to achieve complex goals. Current approaches propose that we understand shared agency in terms of the more basic phenomenon of shared intention. However, they have presented two antagonistic views about the nature of this phenomenon. Some have argued that shared intention should be understood as being primarily a structure of attitudes of individual participants (...) and their interrelations (Bratman, Searle, Tuomela and Miller). Others have claimed that shared intention should be regarded as being primarily a normative transaction which gives rise to interpersonal obligations (Gilbert). In contrast to these approaches, I propose a compromise view. I argue that shared intention involves a complex socio-psychological structure which ensures, in the absence of special circumstances, the existence of relevant moral obligations. My argument involves two main steps. First, I show that shared intention includes important relations of mutual reliance between the participants. Then, I argue that the existence of these relations of mutual reliance in shared intention helps us explain why, failing special circumstances, shared intention generates those obligations. This provides, in my view, a solution to the vexed question of the relation between shared intention and interpersonal obligations. (shrink)

Philosophers have in general offered only a partial view of the normative grounds of reliance. Some maintain that either one of evidence or of pragmatic considerations has a normative bearing on reliance, but are silent about whether the other kind of consideration has such a bearing on it as well. Others assert that both kinds of considerations have a normative bearing on reliance, but sidestep the question of what their relative normative bearing is. 8 March, now known as International Women’s Day, is a day for feminist claims where demonstrations are organized in over 150 countries, with the participation of millions of women all around the world. These demonstrations can be viewed as collective rituals and thus focus attention on the processes that facilitate different psychosocial effects. This work aims to explore the mechanisms involved in participation in the demonstrations of 8 March 2020, collective and ritualized feminist actions, and their correlates associated with personal (...) well-being and collective well-being, collective efficacy and collective growth, and behavioral intention to support the fight for women’s rights. To this end, a cross-cultural study was conducted with the participation of 2,854 people from countries in Latin America and Europe, with a retrospective correlational cross-sectional design and a convenience sample. Participants were divided between demonstration participants and non-demonstrators or followers who monitored participants through the media and social networks. Compared with non-demonstrators and with males, female and non-binary gender respondents had greater scores in mechanisms and criterion variables. Further random-effects model meta-analyses revealed that the perceived emotional synchrony was consistently associated with more proximal mechanisms, as well as with criterion variables. Finally, sequential moderation analyses showed that proposed mechanisms successfully mediated the effects of participation on every criterion variable. These results indicate that participation in 8M marches and demonstrations can be analyzed through the literature on collective rituals. As such, collective participation implies positive outcomes both individually and collectively, which are further reinforced through key psychological mechanisms, in line with a Durkheimian approach to collective rituals. Shared intention normally leads to joint action. It does this, it is commonly said, only because it is a characteristically stable phenomenon, a phenomenon that tends to persist from the time it is formed until the time it is fulfilled. However, the issue of what the stability of shared intention comes down to remains largely undertheorized. My aim in this paper is to remedy this shortcoming. I argue that shared intention is a source of moral and epistemic reasons, that responsiveness (...) to such reasons on the part of each individual reinforces her own relevant attitudes, and that this enhances the stability of the shared intention as a whole. We thus discover an important self-reinforcing and stability-enhancing mechanism at the heart of shared intention and action. It follows from this proposal that the psychological commitment that an individual exhibits in joint action is normally a function not only of her own participatory intention, as often maintained, but also of her endorsement of the reasons created by her group’s shared intention to so act. Philosophers of action of different persuasions have suggested that there is a tight connection between the phenomenon of intending and the phenomena of “being settled on” and of “settling” a course of action. For many, this connection supports an important constraint on intention: one may only intend what one takes one’s so intending as settling. Traditionally, this has been understood as a doxastic constraint on intention: what one takes one’s intention as settling is what one believes one’s so intending as (...) settling. This paper proposes an alternative conception of such a constraint. The idea is to conceive of it in terms of the attitude of reliance, rather than of belief. The aim of the paper is three-fold: to clarify the connection between intending to act and the phenomena of being settled on and of settling a course of action, to provide support for the reliance conception of the cited constraint, and to show that this conception drives a wedge in the familiar dispute, between doxastic and conative accounts of intention, as to whether intending to act necessarily involves the belief that one will so act. Genetic engineering has been a topic of discussion for over 50 years, but it is only recently that gene editing has become a reality. CRISPR biotechnologies have made gene editing much safer, precise and feasible. We have witnessed the first cases of human germline genetic modification resulting in live births, conducted by He Jiankui. In this paper, we will analyse He Jiankui’s case in relation to one of the most difficult problems in procreative ethics (or the ethics of future generations): (...) the non‐identity problem. We believe that this analysis will help us to understand the ethics involved in gene editing and hopefully allow for a better, more philosophically grounded legislation on CRISPR and other gene‐editing technologies. Companies' perceptions of corporate social responsibility have been only partially analyzed from an individual perspective that focuses on personal characteristics and professional backgrounds. However, a gap exists in the research on manager leadership styles and CSR perceptions from a gender perspective. Therefore, this article analyzes differences in attitudes toward various dimensions of CSR by focusing on the leadership styles—transformational, dominance, and dual perspectives—of male and female managers in Spain. A total of 391 respondents in top management positions in Spain were (...) surveyed. The findings revealed similarities and differences between genders with respect to leadership styles and CSR perceptions by dimension using a univariate analysis. A causal model that employed structural equation modeling was also estimated. The findings suggest that for transformational and dual leadership styles, Spanish women may be more adaptable and effective at pursuing company sustainability than Spanish men. However, dominance leadership was found to be the worst leadership style for deploying a CSR strategy. A number of conclusions for business management can be drawn, and some directions for future research are provided. (shrink)

Doxasticism is the thesis that intention is or involves belief in the forthcoming action (Velleman, Harman). Supporters claim that it is only by accepting that thesis that we can explain a wide array of important phenomena, including the special knowledge we have of intentional action, the roles intention plays in facilitating coordination, and the norms of rationality for intention. Others argue that the thesis is subject to counterexample (Davidson, Bratman). Yet some others contend that the thesis can be reformulated in (...) a way that avoids such counterexamples and preserves its explanatory significance (Pears, Setiya). Their suggestion is that we view intention as involving partial –rather than full—belief. I argue that while the move from full to partial doxasticism helps to accommodate such counterexamples, it does so in a way that undermines the ability of the resulting view to explain the coordinating roles of and rationality norms for intention. Court rulings are among the most important documents in all legal systems. This article describes a study in which natural language processing is used for the automatic characterization of Spanish judgments that deal with the physical custody (joint or individual) of minors. The model was trained to identify a set of elements: the type of custody requested by the plaintiff, the type of custody decided on by the court, and eight of the most commonly used arguments in this type of (...) judgment. Two jurists independently annotated more than 3000 judgments, which were used to train a model based on transformers. The main difficulties encountered in this task were the complexity of the judicial language and the need to work with appellate court rulings that have a more complicated structure than decisions at first instance. For the complete court rulings, the F1 score of the inter-annotator agreement ranged from 0.60 to 0.86 and the Kappa index from 0.33 to 0.73. The F1 score of the agreement between the model and the annotators ranged from 0.66 to 0.93 and the Kappa index from 0.57 to 0.80. These results in which the model performance exceeds even the inter-annotator agreement show the high ability of transformers to identify abstract entities in legal texts. (shrink)

We develop an intersection theory for definable Cp-manifolds in an o-minimal expansion of a real closed field and we prove the invariance of the intersection numbers under definable Cp-homotopies . In particular we define the intersection number of two definable submanifolds of complementary dimensions, the Brouwer degree and the winding numbers. We illustrate the theory by deriving in the o-minimal context the Brouwer fixed point theorem, the Jordan-Brouwer separation theorem and the invariance of the Lefschetz numbers under definable Cp-homotopies. A. (...) Pillay has shown that any definable group admits an abstract manifold structure. We apply the intersection theory to definable groups after proving an embedding theorem for abstract definably compact Cp-manifolds. In particular using the Lefschetz fixed point theorem we show that the Lefschetz number of the identity map on a definably compact group, which in the classical case coincides with the Euler characteristic, is zero. El presente trabajo se propone rescatar la resistencia y la crítica al poder imperial romano del libro del Apocalipsis como una fuente fundamental para la teología moral cristiana, que lo convirtieron en un foco de luz que ilumina el camino de la conducta humana hacia un mundo mejor. Al mismo tiempo, ofrece pautas para la defensa de la vida en un entorno donde los totalitarismos políticos, económicos y religiosos atentan contra ella. Además, quiere destacar dicha resistencia y crítica como uno (...) de los factores generadores, y por tanto centrales, de la teología del Apocalipsis. Para ello se utilizarán los principios metodológicos de la lectura contextual que parten de la convicción según la cual el texto es una expresión de las vivencias comunitarias del hagiógrafo y de su actitud ante las circunstancias sociales que lo provocaron. El libro busca afectar el entorno, pero este también configura el contenido de la obra escrita. En un segundo momento, con el método se indaga qué de ese momento histórico puede iluminar el presente del lector. En el caso del Apocalipsis, se elegirán los textos en los que el autor presente los temas y actores principales de la trama, a saber: el ser supremo sentado en el trono, el cordero y el mal —simbolizado específicamente en el tercer jinete—, ya que en ellos se juega el mensaje del libro, la soberanía divina que humaniza o la soberanía diabólica deshumanizante. En este artículo nos proponemos reconstruir las bases de la teoría política calviniana. Intentaremos comprender cómo define el reformador al sujeto político de su teología, donde es definido como Pueblo de Dios. A través de una Teología de la Alianza Calvino establece los términos de un contrato político en el que las instituciones humanas son queridas y establecidas por Dios. A continuación, veremos que el Estado cristiano según Calvino es la plataforma desde la que se promueve el conocimiento de la (...) Voluntad divina, a través de la predicación y la positivación de leyes conformes a la misma. Finalmente, veremos que las ideas del reformador sobre la organización y la naturaleza de la política tuvieron en Ginebra una realización evidente. Ni sus textos ni sus acciones nos permiten calificar a Calvino de constitucionalista o republicano, sino más bien de hombre de orden y defensor de la tradición del derecho divino de los reyes. El presente artículo indaga si ¿es el sujeto un ser autónomo en la deliberación política o sonlos pensamientos, las posturas y las formas de la organización política mediadas por las distintas herramientas comunicacionales a las que se ve expuesto quienes lo determinan? Así, analiza larelación que existe entre mass media y política, con la capacidad deliberativa del individuo altomar decisiones en el contexto político, a partir de Chomsky y Han. La metodología es cualitativa con diseño documental, el instrumento son fichas (...) bibliográficas aplicadas a fuentes primarias y secundarias. Se usan bases de datos con el algoritmo: “Neoliberalismo, psicopolítica, big data, medios de comunicación de masas y democracia”. Se analizan 13 libros y 20 artículos. Se identifican las nuevas formas y herramientas de organización política y la relación entre política y medios de comunicación. Se concluye que: 1) el neoliberalismo direcciona la idea de libre mercado hacia el individuo mismo, 2) es necesaria una ciudadanía crítica que tenga un rol más activo en lademocracia, 3) se identifica a la psicopolítica como una nueva forma de organización política, 4) lanueva herramienta de la política es el big data, 5) se evidencia que la relación entre política y massmedia está vinculada con los grupos de poder y 6) la emocionalización de la comunicación políticadisminuye la autonomía individual. Explicit and implicit learning have been attributed to different learning processes that create different types of knowledge structures. Consistent with that claim, our study provides evidence that people integrate stimulus events differently when consciously aware versus unaware of the relationship between the events. In a first, acquisition phase participants sorted words into two categories , which were fully predicted by task-irrelevant primes—the labels of two other, semantically unrelated categories . In a second, test phase participants performed a lexical decision task, (...) in which all word stimuli stemmed from the previous prime categories and the primes were the labels of the previous target categories . Reliable priming effects in the second phase demonstrated that bidirectional associations between the respective categories had been formed in the acquisition phase , but these effects were found only in participants that were unaware of the relationship between the categories! We suggest that unconscious, implicit learning of event relationships results in the rather unsophisticated integration of the underlying event representations, whereas explicit learning takes the meaning of the order of the events into account, and thus creates unidirectional associations. Hace ya varias décadas que Latinoamérica salió del colonialismo “centroeuropeo”, como lo llama Dussell; sin embargo, se mantiene una actitud de “colonialidad”, entendida como un proceso amplio de control hegemónico de imposición de conocimientos, prácticas y formas culturales en todos los campos de la vida social, al tiempo que se desprecian y desdeñan los valores autóctonos, los conocimientos ancestrales y populares que Boaventura de Sousa Santos denomina con la metáfora de “Las epistemologías del sur”; es decir, aquellas epistemologías de quienes (...) no han tenido voz ni voto en las decisiones trascendentales de la vida social, económica, política y cultural, como los desposeídos, los marginados de la sociedad, campesinos, indígenas, afrodescendientes, homosexuales, entre otros. Los responsables de esta actitud colonialista, no solamente han sido los gobiernos que, mediante convenios y tratados bilaterales y multilaterales con las potencias hegemónicas, financian proyectos de diversa índole e imponen sus criterios e intereses en los distintos campos de la economía, la política y la educación. Pero también la misma educación ha tenido su responsabilidad en este proceso. El conocimiento impartido en las universidades es hegemónico y colonizador, que llega de Europa y Norte América. Por esta razón, la ciencia y el conocimiento que se producen en estas regiones, debe construirse para su validez, con las epistemologías y las metodologías de estas potencias; mientras que los conocimientos culturales, populares y ancestrales, se consideran obstáculos epistemológicos que no pueden convivir e interactuar con la epistemología de la ciencia clásica. Es por esto que la Universidad también tiene que “decolonizar” sus saberes, para alcanzar un espacio transcultural que incluya todos aquellos conocimientos y cosmovisiones populares y tradicionales para que puedan ser tenidos como pares, en un diálogo de saberes dentro de los procesos de formación y aprendizaje. The growth of positive psychology has birthed debate on the nature of what “positive” really means. Conceptualizations of positive attributes vary across psychological perspectives, and it appears these definitional differences stem from standards for “positive” espoused by three normative ethical frameworks: consequentialism, deontology, and virtue ethics. When definitions of “positive” do not align with one of these ethical schools, it appears researchers rely on preference to distinguish positive attributes. In either case, issues arise when researchers do not make their theoretical (...) alignment explicit, leading to value-laden, often subjective criteria being smuggled into science as a description of what is positive. To foster a deeper critical understanding of the different approaches, we examine how these conceptual definitions of positive attributes (mis)align with their ethical traditions or fail to align with an ethical school. In this paper, I will discuss what the first phases of the long history of the transformation of Political in the Spiritual patria consisted of and those who made the development possible. In this essay the main protagonists will be Cicero and Saint Augustine. We will see how St. Augustine could complete the transformation of Cicero's political ideal not only theoretically but practically. St. Augustine's great work can be understood to be a replica of Cicero's Republic in which the City (...) of God is made into the Dream of Scipio and the Church occupies the place of the res publica. On 18 October 1708, Giambattista Vico (1668–1744) gave his seventh inaugural oration, De nostri temporis studiorum ratione (De ratione) at the University of Naples. There, he used the term conspirare to propose collaboration among the sciences. An initial study of the historical context, specifically the scholar’s involvement with the Conspiracy of the Prince of Macchia (1701) and the debates on university reform, makes it possible to formulate a hypothesis regarding Vico’s intent and word choice that enriches our understanding of the (...) preserved text. On a personal level, the Neapolitan professor was looking for a modicum of protection from the new authorities, especially the recently named viceroy in audience that day, Cardinal Vicenzo Grimani. On the political plane, along with a surreptitious argument against tyranny, Vico sought to dissuade the new governors from subscribing to the divisive approach embodied in the university policy of the Cartesian and Bourbonic reformers. Direct analysis of the text of De ratione enabled theoretical scrutiny of the frame from which Vico called for more than mere encyclopaedic knowledge. He was setting forth a vision for a conspiratorial project among the sciences based on a broad understanding of rhetoric. His original proposal for inter- and trans-disciplinarity can inform current debates on the same topic. (shrink)

A finales de 2019 el fotógrafo y escritor Paco Gómez encontró una caja de placas fotográficas en el Rastro de Madrid. Esta investigación trata de analizar el proceso de creación de un relato visual a través de las imágenes descubiertas por dicho autor, y cómo esa historia da lugar a la novela Wattebled o el rastro de las cosas, confeccionando un ejercicio de fotografía expandida hacia la literatura. En dicho proceso creativo se parte de la idea de generar una narración (...) entre esas imágenes y su historia a través de un recorrido al pasado como ejercicio de memoria histórica que permite reconstruir una biografía fami-liar, articulada desde una estrategia de conexiones temporales o heterocronías que ofrecen un sentido y una respuesta a las imágenes halladas. Partiendo de estos planteamientos, este artículo expone el papel que cumplen las imágenes nómadas o desahuciadas y su revitalización como instrumento de reconstrucción de la nostalgia y reencuentro con el pasado, es decir, las cualidades que permiten ofrecer unas fotografías anónimas como objetos portadores de resignificación histórica. En este artículo analizamos la contribución de la teología protestante a la idea de autonomía moral a partir de un análisis de la obra de Juan Calvino. Mostramos cómo se afirma en ella la incapacidad del sujeto para conocer y querer el bien, manifiesto en la ley natural. Esta incapacidad es compensada con los mandatos bíblicos, para los que Calvino justificará una positivación jurídica en los Estados cristianos. Multimedia technologies and ICT in organising e-portfolio for students An electronic portfolio, also known as an e-portfolio or digital portfolio, is a collection of electronic evidence assembled and managed by a user, usually on the Web. Such electronic evidence may include inputted text, electronic files such as Microsoft Word and Adobe PDF files, images, multimedia, Blog entries, and hyperlinks.One of the approaches, which can be used for improving the attractiveness of the e-portfolio is presented, and it is an implementation of (...) the multimedia technologies in it. In this case we are speaking about multimedia electronic portfolio. What makes them very different from the traditional portfolios is that they can include scanned or digital photos, video and sound clips, animations, recordings of the students, text, traditional writings and drawings.Two main groups of tools for creating multimedia e-portfolio are presented. El artículo trata sobre la antropología de la masculinidad y de la feminidad, a partir de la experiencia del cuerpo y de la experiencia de la soledad originaria, tal como Juan Pablo II las analizó en sus Catequesis sobre el amor humano. Así, a partir de la experiencia del propio cuerpo sexuado, podemos llegar a la comprensión de la estructura comunional de la diferencia sexual. Este artículo analiza los fundamentos doctrinales del derecho penal eclesiástico calviniano, asentado teóricamente en la teología del pecado original y cuyo ejercicio toma forma en la práctica del Consistorio ginebrino. Asimismo, explora las razones de la diferencia entre derecho penal eclesial y civil. Y es que, aunque en el calvinismo la Iglesia y el Estado son titulares de un ius gladii, sólo uno de estos sistemas penales puede reivindicar el ejercicio de la pena corporal, el otro tan sólo puede reclamar (...) un castigo espiritual: en esto haremos radicar la diferencia entre derecho y disciplina. El derecho de coacción propiamente dicho pertenece en exclusiva al Estado como tal y ni el individuo ni la Iglesia pueden reclamarlos para sí. Estamos ante una aportación fundamental de la Reforma a la historia del derecho. (shrink)

El propósito de este artículo es cuestionar la lectura tradicional de las Meditaciones metafísicas, una lectura que, abstrayendo del reto escépticode una reducción de la razón al absurdo al que se enfrenta Descartes,magnifica la prioridad epistémica del argumento del Cogito, y que, haciendocaso omiso de su estrategia anti-escéptica, es incapaz de apreciar que, másque la recopilación de mejores evidencias a favor de las proposicionesnucleares, su función es la de sustraer razones para dudar, de tal forma queel Investigador adquiera una posición (...) ilustrada desde la que los escenariosescépticos carezcan de sentido. Descartes propone una versión modal ometafísica de confiabilismo análoga a la defendida en el panoramacontemporáneo por Ernest Sosa, una posición capaz de superar sincircularidad el escepticismo y que muestra cómo el uso correcto de la razón desemboca en una teoría ontológica que elimina la posibilidad de quenuestras facultades cognitivas no sean fiables.
